Special Judge (UAPA) Kiran Bansal rejected the regular bail application of Deepak Nanda alias Deepak Khatri, who had alleged violations of Articles 21 and 22 of the Constitution and Sections 47 and 48 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, citing alleged illegality of arrest, non-communication of the grounds of arrest and illegal remand. This was his second bail application; the first was withdrawn on October 14, 2026, with liberty to file a fresh one.

Dismissing the plea, the court observed that there had been substantial and effective compliance with the mandate of law, and that the reasons for arrest were supplied to the accused against written acknowledgement. It noted that Khatri was produced before the remand court within 24 hours of his detention at the airport, that the grounds and reasons for arrest were communicated to him before 1.32 pm on August 26, and that his wife and counsel were informed orally and in writing on the same day. The court also noted that the accused is himself an advocate and his wife is also an advocate, both well versed with law and procedure.

In its reply, the investigating officer stated that the FIR was registered after secret information was received, following which four accused were apprehended and 10 semi-automatic pistols and 116 live cartridges were recovered in searches. The police say accused Mohd. Rahil disclosed that alleged arms traffickers Shahbaz Ansari and Rehan Ansari were his cousin and maternal uncle respectively; Shahbaz Ansari, arrested by the National Investigation Agency (NIA) in 2022 and later released on interim bail, did not surrender afterwards and left India, and is presently believed to be operating from Bangladesh.

Police told the court that raids in the case have so far led to the arrest of 20 accused associated with the alleged international arms-trafficking and terror module of Shahbaz Ansari, and that a total of 33 high-end foreign-made sophisticated firearms, including two sub-machine guns, and 368 live cartridges have been recovered from their possession or at their instance. The case remains under investigation, and the allegations against Khatri and the other accused have not been established by any court.
