NEW DELHI — Two companies suing each other over the word SUPREME in two different cities will now fight it out in a third. On October 28, the Supreme Court transferred a commercial suit filed by M/s Supremo India Private Limited before the District Judge (Commercial), Indore, and a commercial suit filed by M/s The Supreme Industries Limited before the Delhi High Court, to the City Civil Court, Ahmedabad, Legal Republic reported.

A Bench of Justice S.V.N. Bhatti and Justice N.V. Anjaria chose a venue that neither party had asked for, after each side insisted that the other's suit be moved to its own forum. Supreme Industries had asked for the Indore suit to be transferred to New Delhi, while Supremo India sought transfer of the Delhi suit to Indore, LawTrend reported.

Both sides agreed on one court — and left the choice to the Bench

The Court recorded that counsel for both sides were "at least in ad idem that both matters be tried before one Court" and had left it to the Court to pick that court. The Bench clarified that it was not expressing any view on the merits of the trademark dispute, LawTrend reported.

The order, written by Justice Bhatti and marked non-reportable, disposes of two transfer petitions between the same parties: Transfer Petition (Civil) No. 3594 of 2025 by Supreme Industries and Transfer Petition (Civil) No. 175 of 2026 by Supremo India. Senior counsel Neeraj Kishan Kaul and S. Janani appeared for the parties, Legal Republic reported.

Why a neutral third city?

When each litigant demands the other's case be heard on its own home turf, courts can break the deadlock by choosing a neutral venue neither side picked. Here that venue is Ahmedabad — a city neither company had chosen — so both trademark suits will now be tried together, by one court, on equal footing.

What happens next: the files from Indore and Delhi move to Ahmedabad, and the SUPREME trademark fight itself — on which the Supreme Court expressed no view — will be decided there.
