New Delhi, October 29: The Supreme Court on Thursday disposed of pleas filed by the Chhattisgarh government challenging the grant of bail to retired IAS officer Anil Tuteja in connection with the alleged liquor scam and custom rice milling scam cases, while clarifying that the state government can approach the High Court for cancellation of bail if he is found to have misused his liberty.

"If there is any misuse of the concession of bail, you can approach the High Court for immediate cancellation of bail," a Bench of Chief Justice Surya Kant and Justices Joymalya Bagchi and V Mohana observed. The court also clarified that the findings made by the Chhattisgarh High Court while granting bail were for the limited purpose of the bail applications, and that the trial court shall not be influenced by those observations.

Cautioning the state on the standard of proof, the Bench said: "We are with you that these are the cases where there is strong suspicion of their indulging in corruption. Very strong suspicion at this stage. But that suspicion must be converted into a foolproof evidence. That entirely depends upon your ability." The allegations against Tuteja remain allegations at this stage and are yet to be proved at trial.

State argued a systematic scheme across several alleged scams
The state contended that the same set of accused persons was allegedly involved in a systematic scheme exploiting state resources across multiple matters, naming the alleged liquor, District Mineral Fund (DMF), coal levy, rice milling and manpower cases. Tuteja, who held important positions during the tenure of the Bhupesh Baghel government in Chhattisgarh, was facing investigation in several corruption cases and had remained in custody since January 24, 2024 in various cases before he was released on bail.
With the top court's order, Tuteja's bail continues, but the state retains a clear route back: any instance of misuse of the concession of bail can be taken straight to the Chhattisgarh High Court for cancellation, while the underlying cases proceed before the trial courts on their own merits.
