Goods supplied by a unit in a Special Economic Zone (SEZ) and rejected by the domestic buyer on account of a change in fashion can now be brought back after fulfilling certain conditions, as the government has expanded the conditions for the return of goods supplied by an SEZ unit to the Domestic Tariff Area (DTA), The Hindu BusinessLine reported on October 20.

The notification amending the SEZ Rules, 2006 states: "Goods supplied by a Unit into Domestic Tariff Area on payment of duty may be brought back to the Unit where a Domestic Tariff Area buyer fails to take delivery of the goods due to change in fashion, change in market conditions, or default in conditions of agreement relating to the sale." The goods need to be brought back by the unit within 30 days from the date of clearance from the SEZ unit.

Three conditions must be fulfilled. First, the identity of the goods needs to be established to the satisfaction of the specified officer. Second, the SEZ unit should provide evidence that no benefits — including input tax credit — have been availed by the DTA buyer who failed to take delivery of the goods. Third, a separate inventory of the returned goods needs to be maintained.

The SEZ unit can re-sell the same goods, without any alteration of their original condition, in the DTA either to the same buyer or to a different buyer; on a fresh sale, duty will be required to be paid. "The refund of duty paid at the time of original clearance shall be made," the notification said, adding that a refund of duties on goods received back will also be possible.

The change was notified by the Ministry of Commerce and Industry, Department of Commerce, through the Special Economic Zones (Third Amendment) Rules, 2026 — Notification No. G.S.R. 893(E), dated 15 October 2026 — amending Rule 49(2) of the SEZ Rules, 2006, according to A2Z Taxcorp's summary of the notification. The amended provisions govern the return, resale, refund of duties and repair of goods supplied by SEZ units to the DTA on payment of applicable duties, and came into force on publication in the Official Gazette.
