The Judicial First Class Magistrate Court at Angamaly has denied bail to all four accused in the Nedumbassery Mini Cooper crash that killed three young people, Live Law and Bar and Bench reported. Judicial First Class Magistrate Samyuktha M.K. dismissed the bail applications of Suhail Sajeev, Ninav, Joel and Ameer, holding that the defence arguments involved appreciation of evidence that cannot be conclusively decided at the bail stage, and that the absence of an accused's name in the initial First Information Statement was not by itself sufficient to reject the prosecution's case.

The crash happened in the early hours of October 11 on the Athani-Airport Road at Nedumbassery, near Kochi, when a Mini Cooper allegedly driven by 19-year-old Suhail Sajeev at high speed hit a scooter carrying three young people aged around 21, two of them women. According to the FIR as reported by Bar and Bench, two died on the spot and the third succumbed to injuries later. Nedumbassery Airport Police registered a case under Section 105 of the Bharatiya Nyaya Sanhita (culpable homicide not amounting to murder), and all four accused — the driver and the three passengers, who face abetment allegations they dispute — were remanded to 14 days of judicial custody on October 14.

In a report filed before the court while opposing bail, police said a chemical examination found the alleged driver's blood alcohol concentration at 161 mg per 100 ml and his urine sample at 230 mg per 100 ml, against a permissible limit of 30 mg per 100 ml under Section 185 of the Motor Vehicles Act, PTI reported. Police have also said camera analysis indicated the car was allegedly travelling above 165 kmph on a stretch with a 60 kmph limit, according to The Hindu's reporting — these remain police allegations, and the accused deny culpable homicide, arguing the incident amounted at most to rash and negligent driving.

In the latest development, officials told PTI that the Ernakulam Regional Transport Officer has issued a show-cause notice to Suhail Sajeev, asking him to respond within 14 days, after police submitted a detailed report recommending cancellation of his driving licence; police also reported that the car's exhaust system had been modified. The accused's mother, Nooha, has said she supports the victims' families and wants a fair investigation in which only the truth comes out, PTI reported.
