An off-duty U.S. Immigration and Customs Enforcement agent charged in Fresno over an alleged attack on a 72-year-old man and his daughter has had his bail cut to $37,000 (yaani 37 hazaar dollars) and been given permission to leave California until his next court appearance, KSEE/KGPE reported from a Fresno County courtroom on Tuesday morning, October 20.

The agent, David Gonzalez III, 32, of McAllen, Texas, appeared handcuffed and wearing a red jumpsuit, according to KSEE/KGPE (YourCentralValley). His attorney asked for a bail reduction and for permission to return home to Texas; the judge granted a bail modification to $37,000 and permission to leave the state until his next court appearance, which is set for January 14, 2027, the station reported.

The charges stem from an incident at about 3 a.m. on October 9 outside a Tower District home in the area of East Dudley and North Broadway, according to Fresno police accounts reported by KSEE/KGPE and by Fresnoland. Police said a woman returned home to find Gonzalez allegedly sleeping on the family's front lawn and woke her 72-year-old father, who went outside to confront him. Officers say Gonzalez, who police said appeared intoxicated, allegedly refused to move and assaulted the 72-year-old man, forcing him to the ground, and allegedly attacked the man's daughter when she intervened. The 72-year-old then produced a gun and shot Gonzalez in the stomach, police said. The daughter's boyfriend, an off-duty police officer, arrived shortly afterwards and handcuffed Gonzalez, according to police accounts.

The Fresno County District Attorney's Office announced four criminal charges against Gonzalez on October 14, Fresnoland reported: felony assault likely to produce great bodily injury, felony elder abuse, felony vandalism and misdemeanour battery, in connection with the incident. Prosecutors said at the time that Gonzalez remained hospitalised, that bail was around $52,000, and that his arraignment was scheduled in Fresno County Superior Court. Fresnoland reported the homeowner, whose name has not been released, was cleared in what it described as a self-defence shooting, and that both the man and his daughter suffered minor injuries. Gonzalez has pleaded not guilty, according to local reporting, and faces up to four years and eight months in prison if convicted of all charges, according to the district attorney's office as reported by local media. All of the conduct described above is alleged; Gonzalez has not been convicted.

The case continues with the next court date set for January 14, 2027, KSEE/KGPE reported. The Department of Homeland Security did not immediately return a request for comment when the charges were first announced, according to earlier local reporting.
