Indiana Attorney General Todd Rokita and Vigo County Prosecutor Terry Modesitt have filed felony charges against a Terre Haute-area man accused of voting illegally in multiple elections, WWBL reported on Wednesday, October 21. Prosecutors allege Francisco Aguilar Romero registered to vote in 2018 and voted in six elections through 2024.

Romero, 41, was born in Mexico, according to the Attorney General's office. The Indiana Lawyer, citing the AG's press release and court records on MyCase, reported he is charged with fraudulent voter registration, perjury and three counts of being an ineligible voter, and that he voted in the 2018, 2020, 2022 and 2024 general elections after first registering in 2018. If convicted, he faces a maximum prison sentence of more than 11 years — up to 11 and a half years, WWBL reported.

First prosecution of its kind in Indiana, AG says
Rokita said this is the first such prosecution in Indiana, and he is using the case to urge Congress to pass the SAVE America Act, WWBL reported. In the AG's release, Rokita said he began a process two years ago to verify the citizenship status of registered voters in Indiana, obtained that data from the federal government, and is now acting on it: "Voting by illegal aliens and other noncitizens is unacceptable, and anyone who commits that act must face consequences," he said, adding the enforcement is "certainly not the end." The release also noted that when Romero first registered, neither state nor federal law required proof of citizenship.

The two reports differ on Romero's status: WWBL reported that he holds DACA status, while the Attorney General's press release described him as in the United States illegally. Awaaz Punjab is reporting both descriptions as attributed claims. No attorney for Romero was listed in court documents, and he could not immediately be reached for comment, The Indiana Lawyer reported. The charges are allegations; Romero is presumed innocent unless proven guilty in court.

Charges filed October 21, 2026 in Vigo County: fraudulent/false registration, perjury and ineligible-voter counts. Alleged voting: six elections, 2018–2024, including the 2018, 2020, 2022 and 2024 general elections. Maximum exposure if convicted: more than 11 years. AG Rokita calls it Indiana's first prosecution of this kind.
What is solid
- Felony charges were filed on Oct. 21, 2026 by AG Todd Rokita and Vigo County Prosecutor Terry Modesitt (WWBL; The Indiana Lawyer).
- Court records list charges of fraudulent voter registration, perjury and three counts of ineligible voting (The Indiana Lawyer, via MyCase).
- The AG's office says Romero registered in 2018, before proof of citizenship was required at registration.
What is only claimed
- Romero's immigration status is described differently: DACA holder (WWBL) versus in the U.S. illegally (AG press release).
- Whether every ballot alleged was cast by Romero, and whether he knew he was ineligible, are matters for the court — the charges are unproven allegations.
