A 30-year-old Dearborn woman who shot a man during a fight inside a sneaker store will not face criminal charges, the Wayne County Prosecutor's Office has decided, according to WXYZ-TV reporting of the decision.

The shooting happened just after 6 p.m. on Saturday, October 17, inside White House Kicks, near Ford Road and Oakman Boulevard in Dearborn, police said. The woman, who holds a Michigan concealed pistol licence, had entered the store with her 36-year-old boyfriend. After the boyfriend greeted a shopper, another man attacked him, and security video released by Dearborn police shows the woman drawing a handgun from her purse and firing. A witness told WXYZ she fired three or four times.

The man who was shot, 33, was hit in the back and remained in critical condition in the latest police account. The woman called 911 herself to report the shooting, police said.

Why prosecutors declined charges

Prosecutors said there is not enough evidence to prove beyond a reasonable doubt that she was not acting in self-defence or in defence of another person. That is the reason given for declining charges; it is not a ruling on what anyone else may legally do in a similar situation.

Dearborn Police Chief Issa Shahin said the people involved appeared to know each other before they met in the store. “It's clear they were acquaintances somehow before they saw each other inside the store, and obviously they didn't like each other, because it escalated into a fight,” Shahin told WXYZ. He said the charging decision rests with the prosecutor's office, and that charges could still be filed against the people who instigated the fight.
