Police have invoked Bharatiya Nyaya Sanhita (BNS) provisions relating to culpable homicide not amounting to murder, negligent conduct during the construction or repair of a building, acts endangering human life, causing injury and damaging property. An FIR in the case was registered at the South Campus police station. The charges are allegations set out by the police and have not been proved in court.

The building, known as 'Hostel Daze', was operated as a boys' paying-guest accommodation in South Delhi's Satya Niketan, near Delhi University's South Campus. Police arrested property owner Urmila Gupta, her husband Hari Ram Gupta and their son Mahesh Gupta; the property had been leased to PG operators Shubham Tyagi and Sudhanshu in August 2025, and labour contractor Sanoj was arrested from Kasganj in Uttar Pradesh. A Delhi court extended the judicial custody of the six accused by 14 days on September 22 while the investigation continued.

In a status report filed before the Delhi High Court in September, the Delhi Police said the six accused had allegedly failed to take adequate safety precautions during the repair and structural work at the building, endangering the PG residents. Chief Minister Rekha Gupta had visited the collapse site to monitor relief and rescue work, and within hours the Municipal Corporation of Delhi suspended a deputy commissioner and four engineers over alleged negligence and dereliction of duty.

What happens next

The chargesheet now goes before the Patiala House Court, which will take up the case against the six accused. The Delhi High Court is separately hearing petitions on the safety of paying-guest accommodations in the capital following the September 6 tragedy.
