BIRMINGHAM, Alabama — A fourth person has been arrested in the fatal shooting of Jaxon Trew Bearden, 21, of Alabaster, who was killed on Saturday night, October 24, in the 2400 block of Avenue B in Birmingham's Ensley neighbourhood. The Birmingham Police Department said on Wednesday, November 4, that Breona Marshall, 19, has been arrested and charged with capital murder, WIAT (CBS 42) reported. Marshall is being held at the Jefferson County Jail with no bond.

Bearden was shot at about 9:14 p.m. on October 24 after officers were dispatched to the 2400 block of Avenue B following a ShotSpotter gunfire alert and a report that someone had been shot, according to Birmingham police accounts carried by WIAT. The Jefferson County Coroner's Office identified Bearden and said he was pronounced dead at 10:06 p.m. at UAB Hospital. A woman was also shot in the same incident and suffered a non-life-threatening gunshot wound, police said. Her name has not been released.
Police say the shooting happened during a robbery, which is why the lead charges are capital murder in the commission of a robbery — under Alabama law, a murder committed during a robbery can be charged as a capital offence. That is an allegation the prosecution must prove in court. Marshall, like every other person charged in this case, is presumed innocent unless proven guilty.
Four arrests over eleven days
The first arrests came within about 30 minutes of the shooting. Police arrested Darius Ramone McConis, 18, of Birmingham, and Ja'Maries Antonio Robinson, 20, of Mobile, near Princeton Parkway and Lomb Avenue, WIAT reported from the coroner's and police accounts on October 26. Both were charged with capital murder in the commission of a robbery and taken to the Jefferson County Jail to be held without bond.
On October 30, police arrested a third suspect: Cavalli Jackson, 18, of Stone Mountain, Georgia, was taken into custody by the Birmingham Police Department's Violent Crime Apprehension Team and charged with felony murder, WIAT reported on October 31. Jackson is also held at the Jefferson County Jail with no bond. Wednesday's arrest of Marshall — whose alleged role police have not publicly described — makes her the fourth person charged in connection with Bearden's death in eleven days.
What police have and have not said
Birmingham police designated the case the city's 35th murder investigation of 2026. Beyond the robbery allegation, investigators have not publicly described what led up to the gunfire on Avenue B, whether the people involved knew one another, or what evidence connects each of the four accused to the shooting. No weapon recovery has been announced in the reporting, and no court dates for Marshall or the other three defendants had been announced when the November 4 arrest was reported.
Jaxon Bearden, 21, of Alabaster, died at UAB Hospital on October 24. A woman whose name has not been released was wounded and survived. Four people — two teenagers and two aged 20 and 19 — now face capital murder or felony murder charges. Charges are allegations, not convictions.
Ensley, in western Birmingham, is a historic neighbourhood that has carried a heavy share of the city's gun violence for years, and Avenue B is one of its main streets. For Birmingham families — and for the truckers and warehouse workers who pass through the city's I-20, I-59 and I-65 junction daily — cases like this one, in which a 21-year-old dies during an alleged street robbery, are the local face of a robbery-and-gun problem that police say ShotSpotter alerts now bring to them within seconds.
What happens next: all four accused are held without bond at the Jefferson County Jail. Their cases will move through Jefferson County's courts, where prosecutors must prove the capital murder and felony murder allegations — including, for the capital charges, that the killing happened during a robbery — beyond a reasonable doubt. Awaaz Punjab will update this story when court dates or further verified detail are announced.
