A division bench of Chief Justice Sanjay K. Agrawal and Justice Sameer Jain passed the order on Monday, November 2, 2026, while hearing a public interest petition filed by the Citizens Protection Society in 2023 (D.B. Civil Writ Petition No. 10610/2023). No one appeared for the petitioner when the matter was called, and the court proceeded on the petition, The Times of India reported.

Loud music, laser lights and fireworks alleged in the PIL

According to the petition, marriages and private functions were being held at the site with loud music, laser lights and fireworks late at night, and a restaurant was being run there under a tender dated September 14, 2022. The court noted that because the property lies next to a wildlife area, such activities cause discomfort to protected wildlife and ought to be prohibited, referring to the principles laid down in T.N. Godavarman Thirumulpad v. Union of India.

The Additional Advocate General told the court that no marriages or commercial activities were taking place at the property and that the 2022 tender had expired. Counsel for the forest authorities said the same.

Complete ban with immediate effect; commissioner to inspect

Taking note of the expired tender, the bench directed a complete prohibition, with immediate effect, on commercial use of the property for parties, marriages, restaurants or any similar use. It appointed advocate Apeksha Bapna as court commissioner to inspect the premises, take photographs and submit a detailed report, with her fee of Rs 25,000 to be borne by the State.

The officer in charge of the property has been directed to remain present on the next date and explain how tenders came to be issued for a property adjacent to the forest area. The court also sought an explanation from its Registry for listing the matter under the admission category despite an order dated September 29, 2026 directing that it be listed for final hearing. The case will be heard next on December 8, 2026.
